Know Your Rights - and What They Mean

Lets start by reviewing some rights.

To report a citation or confiscation of harm reduction supplies, scroll to the bottom of page please.

  • As stated in CA Health and Safety Code 11364. You are able to carry syringes for personal use and/or stored in safe disposal container.

     “It is unlawful to possess an opium pipe or any device, contrivance, instrument, or paraphernalia used for unlawfully injecting or smoking … shall not apply to hypodermic needles or syringes that have been containerized for safe disposal in a container… does not apply to an individual obtaining controlled substance checking services… not apply to the possession solely for personal use of hypodermic needles or syringes”

  • As stated in CA Health and Safety Code 121349. You have the right to carry any harm reduction supplies distributed by any authorized syringe exchange.

    “…participants shall not be subject to criminal prosecution for possession of needles or syringes or any materials deemed by a local or state health department to be necessary…”

  • As stated in CA Health and Safety Code 121349 and in CA Health and Safety Code 11364. You have the right to possess drug equipment obtained from an authorized entity. You have the right to possess drug equipment intended for personal use. You have right to posess equipment intended for testing of substances.

  • As stated in CA Health and Safety Code 11350 you have the right to seek medical assistance on behalf of someone experiencing a drug-related overdose. Often known as the “Good Samaritan law”.
